Artificial intelligence (AI) represents a valuable tool that could be used to improve the safety and efficacy of care. 

Federal:  HR.6936/S.3205 Federal Artificial Intelligence Risk Management Act of 2024 

State:  Artificial Intelligence Protections 

  • California:  The first, the “Physicians Make Decisions Act” (SB 1120), requires that AI tools used by insurers in making coverage decisions must consider a patient’s medical and clinical history, as well as their specific circumstances. Importantly, the law mandates that physicians, not AI systems, have the final authority in determining medical necessity. 
  • California  The second law, “Health Care Services: Artificial Intelligence” (AB 3030), requires providers to disclose when AI has contributed to drafting written or verbal communications related to a patient’s clinical information. This applies to various healthcare settings, including hospitals, clinics, and physician offices. 
  • With these two new health AI laws, California joins Utah and Colorado in passing significant legislation this year governing the use of AI tools in healthcare. Learn more here. 

Federal: Improving Seniors’ Timely Access to Care Act S.4532

Will limit excessive prior authorization requirements within the Medicare Advantage program.  It would: 

  • Establish a standardized, electronic prior authorization process 
  • Clarify timeframes for response 
  • Require HHS to provide reports to Congress on how they are seeking to improve the prior authorization process 
  • Require Medicare Advantage plans to provide a list of all items and services subject to prior authorization, as well as percentage and number of specific requests approved and denied in the previous plan year.   

Federal: Advancing Research for Chronic Pain Act (S.2922/H.R.7164)

The Advancing Research for Chronic Pain Act aims to address the gaps in chronic pain research by requiring the CDC to collect, analyze, and publish population health data on chronic pain conditions. 

The Advancing Research for Chronic Pain Act has been added to the SUPPORT for Patients and Communities Reauthorization Act (S.3393). 

NIH Clinical Trial Diversity Act

NIH Clinical Trial Diversity Act plays a crucial role in promoting inclusivity and equity in headache research, leading to better understanding, treatment, and outcomes for individuals across diverse demographic groups affected by headache disorders.

Office of Caregiver Health

Establish an Office of Caregiver Health at the Department of Health and Human Services (HHS) to improve the efficiency and effectiveness of federal programs.  

Family caregivers experience disproportionate physical, emotional, and financial strain and social isolation because of their caregiving responsibilities. They span every generation, come from all backgrounds, and care for individuals with a wide array of conditions and payors.
